TERMS AND CONDITIONS
Although Safaris by Max Obell LTD (herein referred to as Safaris by Max) endeavors to provide accurate, up-to-date and truthful information on this site, neither Safaris by Max nor any of its employees, agents and associates make any representations or give any warranties, whether expressly, tacitly or implied, as to the operation of the website, the information, content, materials and products included .

Safaris by Max, its employees, agents and associates will not be liable for any damage arising or resulting from the use of or inability to use this site or the information contained herein, including but not limited to direct, indirect, incidental, punitive and consequential damage. Safaris by Max will treat all personal information you provide us as strictly confidential and no personal information will be made available to third parties, unless obliged to do so by law or legal process.

Booking
In order to make your booking, please be sure that you have provided full legal names, nationality and date of birth of all travelers as per their passports. If an accommodation is fully booked Safaris by Max will attempt to offer you an alternative property of a similar standard and location. A booking is binding for both the Guest and Safaris by Max once the deposit has been paid.

Conditions of Payment
The following rules apply unless other conditions are stipulated in the tour. At the time of booking, a deposit on 30% of the total tour price per person is required. The remaining payment must be submitted no later than 90 days prior to departure date. If the deadline for the remaining payment is exceeded, Safaris by Max may be unable to confirm the booking for the Guest. Bookings made within 90 days of departure require immediate full payment.

All payments must be made by a wire transfer (SWIFT), or thru our secure online payment system. Funds are normally cleared within five to seven working days.

Cancellation
Cancellation of bookings must sent to Safaris by Max by email to hello@safarisbymax.com as soon as possible and confirmation of receipt of cancellation must be confirmed in writing by Safaris by Max. If there is no acknowledgement of the cancellation from Safaris by Max, it means your cancellation notification has not been received and therefore not valid.

The following rules apply unless other conditions are stipulated in the tour itinerary.

Cancellation policy

More than 120 days prior to start of tour $300 per person administration fee
120 – 60 days prior to start of tour 20% of total amount paid
59 – 30 days prior to start of tour 50% of  total amount paid
29 days or less prior to start of tour 100% of total amount paid

The trip may be cancelled with no penalty charge should war, a life-threatening epidemic, or any other natural catastrophe or similar event occur within 14 days prior to departure. This will however be on the condition that your government advises against travelling to the specific area, and that the situation in question has arisen after the booking of the tour was made.

Cancellation by Safaris by Max
In the unlikely event that Safaris by Max has to cancel a tour or a service for any reason, we will try to offer the choice of an alternative arrangement; otherwise you will receive a full refund. We will do our utmost to inform you about any cancellations at the earliest possible convenience and at the latest 14 days before the commencement of the tour.

The tour may also be cancelled due to circumstances beyond our control and which neither our partners nor Safaris by Max could have foreseen (force majeure). In such cases Guests will be refunded the price of the trip but will not be able to claim any extra expenses. Should one of the aforementioned emergency situations arise, Safaris by Max will always try to offer an acceptable alternative.

Passports and Visas
Obtaining a passport and visa for entry to the country/countries in which the tour takes place is the responsibility of the traveler. We would like to remind you that visas on arrival in Kenya are no longer available and must be applied for online at https://evisa.go.ke/evisa.html

The traveler must ensure that he/she has a valid passport and visa and has given Safaris by Max the correct information regarding his/her name and nationality, etc.  Safaris by Max cannot be held responsible for travellers who, for whatever reason, may be denied entry at a border.

Please be aware that rules and regulations may change between the time of booking and the time of departure.

Also, please note that there may be visa requirements when in transit. Your passport must be valid for a period of at least six months after returning from your destinatio. The passport should have at least two blank pages and these blank pages exclude pages reserved for endorsements and amendments

We are always happy to supply you with any relevant travel documents that may be needed to apply for a visa if you need them.

Vaccination Requirements
Information about which vaccinations are required should be obtained from your GP/physician. Any advice given by Safaris by Max about vaccinations and/or prophylactic measures or other medical advice should be considered as an extra service and that we are not qualified to give medical advice and accept no liability for it.

Changes In Prices
In accordance with legislation, tour operators may raise the agreed-upon price as a result of increased transportation costs (including increased fuel prices), altered taxes, tariffs and fees, as well as fluctuating exchange rates.

Price increases will take place according to the following principles:
All prices are based on costs at the time of publication. Safaris by Max reserves the right to change the prices at any time before your booking is made. Safaris by Max will confirm price changes, if any, together with the confirmation of your booking. Some service prices, such as (but not limited to) park fees, government levies and airport taxes are not in the control of Safaris by Max. In the event of these prices being changed at any date Safaris by Max will charge the supplement to the client at cost.

Travel Insurance
Safaris by Max cannot be held responsible or liable for any loss, damage or theft of baggage or personal belongings, nor for personal injury, accident or illness. We strongly recommend you purchase insurance covering tour cancellation and interruption, lost or damaged baggage and medical. Baggage is at owners risk throughout the safari unless insured.

Liability Limitation
Each tour package comprises one or more service components including the organization of transport, meals, entrance fees, accommodation and/or other facilities or services. Safaris by Max has no direct day-to-day control over its suppliers. Accordingly Safaris by Max accepts no responsibility for any injury, damage, loss, accident, delay, irregularity and/or inconvenience which may be occasioned by any defect in anything (including vehicles) utilized by any supplier for the provision of any service. Neither will Safaris by Max accept liability for any shortcomings of service caused by an act or omission of any supplier or its employees or agents.

Safaris by Max shall not be liable for any loss or expense arising from the loss of property, cancellation or curtailment of the tour however caused, save to the extent that such loss of baggage, cancellation or curtailment was caused directly by the negligence of Safaris by Max.

If sickness or an accident interrupts a tour, Safaris by Max shall not be liable for any subsequent cost or expense, save only to the extent that such sickness or accident was caused beyond any reasonable doubt by a willful act of Safaris by Max or by gross negligence. Safaris by Max shall not be liable for any refund, either total or partial, of passage money paid and we recommend that travelers take out the necessary insurance to protect against such an eventuality.

In the case of a claim being made, Safaris by Max must receive said claim in writing no later than 28 days from the end of our services under the contract. Where any payment is made, you will assign to Safaris by Max any right you may have to pursue any third party in relation to the claim and provide us with your full co-operation.

In general, please note our responsibilities and obligations apply only in respect to those services which Safaris by Max agrees to arrange or provide on your behalf. Safaris by Max cannot accept any liability for any services arranged by yourself.

Your Responsibility
As mentioned above your participation in a tour is subject to your being aware of the above information as well as the information on the website, on the invoice and in the itinerary, and to your following the aforementioned regulations. It is also expected that you seek up-to-date information about the current matters concerning the political, health, natural and climatic conditions at your destination.

Claims
If you have a complaint it must be directed to Safaris by Max as soon as the problem comes to light so that we may attempt to rectify the situation. Should you remain dissatisfied, please write to us setting out the complaint in detail within 28 days of the end of the tour. Safaris by Max cannot accept responsibility for any complaints of which we are not notified of entirely in accordance with this clause. Should any legal dispute arise it must be settled in Nairobi, Kenya.
